Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, applications, and services provided by Temet ("Temet," "we," "us," or "our") (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
Temet is a personal health platform that lets you connect health data sources (wearables, labs, genetics), track interventions such as supplements, exercise, diet, and sleep, run structured self-experiments, and receive data-driven insights. We may add, change, or remove features over time. We will not materially reduce the core functionality of a paid plan during a period you have already paid for.
2. Not Medical Advice
The Service — including all metrics, correlations, experiment results, and AI-generated insights — is provided for informational and educational purposes only. It is not medical advice, diagnosis, or treatment, and it is not a substitute for the judgment of a qualified healthcare professional.
Always consult a physician or other qualified provider before starting, stopping, or changing any supplement, medication, diet, or exercise program, and never disregard professional medical advice because of something you read in the Service. If you think you may have a medical emergency, call your doctor or emergency services immediately.
3. Eligibility and Your Account
You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@temethealth.com if you suspect unauthorized use. You agree to provide accurate account information and keep it up to date.
4. Subscriptions, Billing, and Refunds
- Paid plans are billed in advance on a recurring basis (monthly or annually) through our payment processor, Stripe, and renew automatically until cancelled.
- You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period, and you retain access until then.
- Except where required by law, payments are non-refundable and we do not provide credits for partial billing periods.
- We may change our prices with at least 30 days' notice; price changes apply from your next billing period.
- If a payment fails, we may retry it and, after reasonable notice, suspend or downgrade your account.
5. Your Data
You retain all rights to the data you connect to or store in the Service, including health metrics, lab results, genetic data, and experiment records. You grant us a limited, non-exclusive license to host, process, and display that data solely to operate, secure, and improve the Service as described in our Privacy Policy. This license ends when you delete the data or your account, except for limited retention required by law.
You can export your data or delete your account at any time from your account settings.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Access or attempt to access another user's account or data without authorization.
- Probe, scan, or test the vulnerability of the Service, or circumvent its security or authentication measures, except through a coordinated disclosure program we operate.
- Interfere with the Service's operation, including by transmitting malware, scraping at scale, or imposing an unreasonable load on our infrastructure.
- Resell, sublicense, or provide the Service to third parties as a service bureau without our written consent.
- Reverse engineer or copy any part of the Service except as permitted by law.
7. Third-Party Services
The Service integrates with third-party providers you choose to connect, such as wearable platforms, lab services, and genetic data providers. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for their availability, accuracy, or practices. If a provider changes or discontinues its API, connected features may stop working, and we are not liable for the resulting loss of functionality or data flow.
8. Intellectual Property
The Service, including its software, design, text, graphics, and trademarks (excluding your data), is owned by Temet or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use in accordance with these Terms. If you send us feedback or suggestions, you grant us the right to use them without restriction or compensation.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DATA FROM CONNECTED PROVIDERS WILL BE ACCURATE OR COMPLETE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEMET AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
11. Indemnification
You agree to indemnify and hold harmless Temet and its officers, employees, and agents from any claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Service.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service (in which case we will give you reasonable advance notice and an opportunity to export your data). Sections that by their nature should survive termination — including Your Data (as to retained records), Disclaimers, Limitation of Liability, Indemnification, and Governing Law — survive.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@temethealth.com; if we cannot resolve it within 30 days, either party may pursue formal proceedings. Any claim must be brought in the state or federal courts located in Delaware, and both parties consent to their jurisdiction, except that either party may seek relief in small-claims court where eligible. Nothing in this section limits any non-waivable rights you have under the consumer-protection laws of your place of residence.
14. Changes to These Terms
We may revise these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 14 days before they take effect. The "Effective date" above reflects the most recent revision. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
